BimmerFix Terms of Use

1. Acceptance of Terms

By downloading, installing, or using BimmerFix ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.

2. Description of Service

BimmerFix is a vehicle diagnostic application that communicates with BMW vehicle electronic control units (ECUs) via OBD-II adapters. The App provides fault code reading and clearing, live sensor data monitoring, ECU coding and adaptation, service reset functions, and repair guidance.

3. Auto-Renewable Subscriptions

BimmerFix offers auto-renewable subscription plans:

Basic Plan: $24.99/month or $249.99/year — fault codes, live data, service resets, repair guides
Pro Plan: $69.99/month or $699.99/year — everything in Basic plus ECU coding, data logging, and advanced features
Dealer Plan: $174.99/month or $1,749.99/year — everything in Pro plus professional adapter support, multi-technician access, and commercial use

All plans include a 7-day free trial for first-time subscribers.

Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel subscriptions in your App Store account settings. No refund is provided for unused portions of a subscription period.

4. Vehicle Modification Disclaimer

BimmerFix communicates with your vehicle's ECUs to read data and, on supported plans, modify coding parameters. ECU modifications may affect your vehicle's warranty, emissions compliance, and safety systems. You assume full responsibility for any ECU coding, adaptation, or programming performed using BimmerFix. BimmerFix LLC is not responsible for any vehicle damage, warranty voidance, or legal consequences resulting from ECU modifications made through the App.

5. User Responsibilities

You must own or have explicit permission from the owner to perform diagnostics and coding on any vehicle
You are responsible for ensuring your use complies with all applicable laws and regulations
Do not perform ECU modifications while the vehicle is in motion
Verify all coding changes before operating the vehicle
Maintain current backups of original ECU data before applying modifications

6. Account

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access to your account. BimmerFix LLC is not liable for any loss or damage arising from unauthorized account access.

7. Prohibited Uses

You may not use BimmerFix to:

Modify vehicles you do not own or have no authorization to modify
Circumvent emissions regulations or safety systems
Reverse engineer, decompile, or disassemble the App
Use the App for commercial purposes on the Basic plan
Resell or redistribute access to the App

8. Intellectual Property

All content, features, and functionality of BimmerFix — including but not limited to the fault code database, repair guides, ECU coding libraries, and software — are owned by BimmerFix LLC and are protected by copyright, trademark, and other intellectual property laws.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIMMERFIX LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO VEHICLE DAMAGE, LOSS OF DATA, OR LOSS OF PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. BIMMERFIX LLC DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association.

12. Changes to Terms

BimmerFix LLC reserves the right to modify these terms at any time. Continued use of the App after changes constitutes acceptance of the revised terms. We will notify users of material changes through the App.
